The use of Sales Tax Essay Example | Topics and Well Written Essays - 750 words

The use of Sales Tax - Essay Example The drive of capitalism for this country relied on many factors that included slavery, turned raw goods into products, factories, and the ability to produce such a drastic workforce. Hence, Smith’s ideas of capitalism along with an adequate tax system that can power the nation in its quest to be financially solidified. The use of sales tax in America is implemented at a state level and is utilized for education, infrastructure, and Medicare. Many cities and countries have their own special rules regarding state tax. In essence, there is no federal sales tax. Clearly, that is because the population of state tax varies based on population, deficit, and economic growth (â€Å"Rousse, 66†).   Although no clear of sales tax can be found during the revolutionary time period, the forefathers of the country did implement an excise tax on whiskey enacted in 1791. For instance, Minnesota does not have a sales tax. Sales tax is calculated by multiplying the original price of the item by a tax rate. Sales tax is also special in a fact because it is collected at the time of sale (â€Å"Rousse, 66†).    Sales tax is unique in its manner because it is only imposed once during the time of purchase. However, this rule can be modified. For instance, items such as used cars fit this description. In this particular scenario, sales tax can be charged on the same item multiple times (â€Å"Rousse, 66†). The common example of sales tax is prevalent in grocery stores in which individuals are charged with this tax when buying their produce and groceries. Researchers that study economics have comprehensively studies the effects of sales tax have concluded that it harnesses the local economy. One of the key elements that sales tax is utilized for is to fund education. Since sales tax is based on a state basis. Illinois is a prime example of this sales as the school system is injected with sales tax revenue (â€Å"Rousse, 66†). This is essential beca use the money is allocated in a very efficient manner that benefits the economy. Since the housing market is on the bubble right now, the sales tax that is derived from the properties are valuable enough to dictate funding of education. As a matter of fact, lawmakers approved sales tax as a funding source for school districts in 2007. Since the market is on the bubble, many economists say that it makes logical sense to facilitate individuals by relying on sales tax rather than property tax. The debate over sales tax has been the hallmark of criticism and critique. Many individuals feel that the sales tax should be regressive just like the progressive tax. Many people insist that the sales tax imposes a huge burden on low-income families. In addition, the government is contemplating the decision to charge sales tax to online retailers. During the year of 1992, the Supreme Court ruled that retailers don't have to collect sales taxes in states where they do not possess any leverage (â €Å""Should States Require Online Retailers to Collect Sales Tax?† ). Both state and the local government has been urging Congress to repeal that decision and actually charge online retailers a sales tax as numerous bills have been proposed in Congress. Many Americans feel that shopping online is cost-effective as it allows them to skip this tax. In essence, if an individual bought items from an online retailer, they are obligated to owe tax to state even though the states really do not have supreme authority to

The role of the neuromuscular system on work and exercise Essay

The role of the neuromuscular system on work and exercise - Essay Example A nerve impulse from the brain travels through the nerve and cause the release of acetylcholine at the nerve junction. This chemical is picked by chemical receptors in the muscle that effect the movement. Hypertensive individuals are treated with calcium blockers and catecholamine blockers. These drugs protect the hart from heart attacks by neither blocking the action of nor adrenaline which initiates the flight or fight response. They block the reception of stress hormones such as epinephrine weakening their effects. This reduces hypertension. Nevertheless, this also has some adverse effect on the individual because it blocks the absorption of calcium to the ones. As a result, the individual taking the treatment has a high risk of developing ostereoporosis. The motor skills of the patients are also adversely affected because of reduced calcium in the bones. As a result, this type of medicine is not good for physically active individuals or athletes as it affects their performance. This is because they block the uptake of oxygen and make exercise to be more strenuous. Some patients may even stop taking the drugs. Calcium channel blockers also have adverse effects on skeletal movements. They inhibit the movement of calcium inwards by slowed channels into the heart, blood vessels allowing the heart to pump blood more easily and increasing the width of the blood vessels. As such, the heart doe not strain in pumping blood lowering the blood pressure. Increase in intercellular concentration of calcium results in eccentric contraction that causes damage in the skeletal muscles by damaging the muscle protein structure (Blottner & Salanova 2010). The damage arises from increased resting calcium, profound loss of involuntary ad voluntary muscles and increase in intracellular calcium concentration. Caffeine is a mild stimulant. It effects as a stimulant and affects brain activity. Caffeine is quickly absorbed by the body the moment

Palsgraf v. Long Island Railroad Co Essay Example | Topics and Well Written Essays - 1250 words

Palsgraf v. Long Island Railroad Co - Essay Example This is because; there are laws that explicitly spell out the obligation of corporate entities in ensuring public safety and the responsibility these entities are to be charged with, when these standards are not met. One of the most significant law of tort cases in the US is the Palsgraf v. Long Island Railroad Co., 248 N.Y. 339, 162 N.E. 99 (N.Y. 1928). The case can aptly be described as significant since its effects shaped and established the concepts of the scope of business liability, the relevance of proximate cause and the limits of negligence. A Brief Summary on the Case At the heart of the case is Mrs. Helen Palsgraf who was waiting on a Long Island Railway train platform, until two men approached running after a train. As a security officer helped one of the men get on board, the man dropped his package. Since this luggage contained explosives, an explosion of a very powerful scale resulted there-from. This resulted in Palsgraf’s injury. Mrs. Palsgraf entered a person al injury lawsuit against the company, Long Island Railroad. The two main issues that emerged from the case are: the manner of determination of the duty of care; and the person to whom the party owes its duty of due care. In this case, the Court of Appeals ruled against the favor of Mrs. Palsgraf. The court maintained that there was no direct relationship between the guard’s action (of pulling the second passenger on board) and Palsgraf’s injury. The crux of the matter is that there has to be a direct nexus between the guard’s action and Mrs. Palsgraf’s injury, in order for liability to be cited. The Senior Judge Benjamin Cardozo, while writing for the three-judge bench, maintained that the guard in no way was aware of the presence of the explosion in the package. Therefore, by shoving the passenger inside, he was not aware that an explosion would ensue. Cardozo continued that even the most cautious mind could not guess the presence of danger in the packa ge. Moreover, there was no way the soldier’s action of pushing the passenger into the train directly affected Mrs. Palsgraf. Cardozo affirmed that not only was the harm emanating from the guard not willful, but his act was also not in itself dangerous. This is to the effect that the act of pushing the passenger into the train was not in violation to Palsgraf’s rights (Cross, 2011). Personal Opinion about the Case and How It Relates To What Is Being Learnt On personal grounds, the case was justly ruled by Senior Judge Cardozo and the three-judge bench. Palsgraf’s claims in her personal injury legal suit against Long Island Railroad are not sustainable, on several grounds. Lessons that have been drawn from classroom context underscore this standpoint. One of the lessons gleaned from the classroom lectures is that of the limitations of negligence. Generally, to find negligence, there must be a total finding of an instance where a particular duty owed was breached. In respect to the foregoing, to find negligence with Long Island Railroad, evidence must be produced on the side of the company’s personnel. There is no clear relationship between the guard’s action and Mrs. Palsgraf’s injury so that he can be accused of negligence. In a closely related wavelength, the limitations of liability require that the injury or liability sustained must have been avoidable, should the defendant have acted responsibly. This aspect of making harm avoidable is only applicable in light of knowledge.

Tupac Shakur Is Still Alive Essay -- essays research papers

Tupac Shakur Is Still Alive   Ã‚  Ã‚  Ã‚  Ã‚  On September 7, 1996, Tupac Amaru Shakur was riding in the passenger side of a black BMW driven by Marion Suge Knight, president of Death Row Records. Tupac and Suge had just finished watching Mike Tyson defeat Bruce Seldon at the MGM Grand in Las Vegas, Nevada. Tupac was standing up through the sunroof while the car was stopped at a traffic light. The Cadillac containing the gunmen passed an entourage of Tupac’s allies, many of them bodyguards. Four unidentified men pulled alongside Suge’s car, fired 13 rounds, and sped away. No one gives chase and there were no witnesses on the street. How come? Why not, especially after a heavyweight fight? Tupac was shot in multiple places including his pelvis, hand, and torso. Suge was grazed in the head w/ a slug of a bullet fragment. On Friday, September 13, 1996, he was reportedly pronounced dead at 4:03 p.m. at the University Medical Center in Las Vegas. But, did he really die? There are many suspicious deta ils about his departure that contribute to this theory. It is supposed that Tupac is still alive b/c of things said before and after his death, actions done before and after his death, and other reports.   Ã‚  Ã‚  Ã‚  Ã‚  Ã¢â‚¬Å"I got a big money scheme, and you ain’t even wit’ it,† 2Pac states in the song â€Å"I Ain’t Mad At Cha.† 2Pac certainly earned a lot of money by faking his death. His LP All Eyez On Me (1996), rap’s first 2 disc album, shot back up to the Billboard top 10 in the weeks following his death. His latest CD, The Don Killuminati: The Seven-Day Theory, recorded under the alias Makaveli, debuted on the Billboard charts as the number one album in the nation. By selling 664,000 copies, it surpassed the â€Å"gold† plateau in one week and is now a multi-platinum hit. Sales of his other CD’s also increased dramatically, w/ his third solo album, Me Against the World (1995), actually climbing back onto the Billboard charts.   Ã‚  Ã‚  Ã‚  Ã‚  Las Vegas is a payoff city, meaning all sorts of folks have been known to be on the take, like lawyers, doctors, press, etc. When Tupac was in the Las Vegas hospital and one of his lungs was removed, the doctors were tight-lipped about his condition. One nurse made the public statement that Tupac would live and that she was positive of it. The fact that a trained medical professional state... ...ere canceled in Los Angeles and Atlanta, both of which were open to the public.   Ã‚  Ã‚  Ã‚  Ã‚  One counterargument that may mislead people into thinking that Tupac is still alive is the fact that an autopsy picture and report were released. Have you ever been standing in a grocery line and happen to see The National Inquirer? Well, if so, then you know how pictures can be altered, right? Also, on the autopsy report, it states that he weighed 215 pounds when he only weighed 168. Not only that, but it also declares that he was 6’ 2† when he was only 5’10†.   Ã‚  Ã‚  Ã‚  Ã‚  Another counterargument that is trying to disprove his still being alive is that his mother is going around the country speaking of her son’s death. Of course she or anyone for that fact, that knows that he is still alive isn’t going to admit it. He supposedly faked his death, then why would anyone blow his cover by admitting that he is still around?   Ã‚  Ã‚  Ã‚  Ã‚  Once one summarizes all the evidence, the things said before and after his death, actions before and after his death, among other reports, it becomes obvious that Tupac Amaru Shakur is not dead.

The Ethics of Steroids in Professional Sports

Currently in professional sports, the use of steroids is one of the most highly debated and controversial topics. It seems that every day there is an athlete being suspended, fined, and even prosecuted for using these performance-enhancing drugs. In many cases, sports fans will condemn these athletes for their involvement in steroids. As I looked deeper into the subject I thought to myself, â€Å"what is so wrong with athletes trying to take their game to the next level?† Because ultimately, that’s what the real issue is here; its just professionals doing what they can to get ahead in their job and it seems to be perfectly ethical. One of the main arguments in the ethics of steroids in professional sports is that it is unhealthy to the body, which is completely true. The prolonged used of anabolic steroids can cause liver damage and contribute to hormone imbalances among other things; however, this does not make it unethical. Let’s not forget that these athletes a re playing sports that in many cases are already a danger to their bodies. When was the last time you heard of an athletes going to the hospital for the use of steroids? Yet everyday there is a case of a professional athlete tearing a muscle or incurring serious head injuries. Studies actually show that deaths from playing college and professional football are 50-100 times higher than the use of steroids. Just because somebody does something that may be harmful to their body, it doesn’t mean their wrong in doing so. For example, if a guy is hungry and decides to eat out at a fast food restaurant, is he pursuing something unethical? We all know the unhealthy effects fast food has on the body, but that doesn’t make it wrong. Adults should be able to make their own decisions when it comes to their personal well-being and if they decide to do something that may be harmful, then so be it.Protestors against steroids also claim that athletes using performance-enhancing drugs are a bad influence on our youth. Kids idolize athletes and if they see their favorite superstar using steroids, then they will want to also. I do see some truth in that and agree 100 percent that there is no place for steroids in child’s body. On the other hand I also contend that professional athletes have no obligation to live their lives conforming to a â€Å"role model† image. In Major League Baseball, the players are allowed to use chewing tobacco during games and it is clearly seen by the youth watching on TV. Also, In the National Hockey League, there is an immense amount of violence and fighting plays a big part in the sport. These examples are also bad influences on children, yet they are apart of the game and don’t seem to be getting banned anytime soon.As for the argument that steroids taint the game that so many love, I don’t see truth in this at all. There are constantly new techniques and technology being added in sports all for one purpose , to make the game better. Athletes dating back to the ancient times have been doing whatever they can to gain a competitive edge. The Greeks used to eat live bees for potency before matches and Mayans would take hallucinogens to numb the pain taken from their sport. So why is it unethical for an athlete to use steroids for this same purpose? Some say that athletes in the past didn’t have the luxury of steroids, so it eliminates the records and legacy of the past. But regardless, due to the revolutionary increases of technology, such as a newly designed baseball bat or a more aerodynamic track uniform, players are going to be better and these records are going to be broken.
